Here’s the deal. CAFC knows Amarin is filing an en banc and if it reallly sucks CAFC will deny it faster than first appeal. Why? Because Amarin has another appeal.... Amarin is wasting the CAFC’s time and it’s starting to even piss investors off.
Should Amarin file en banc? Yes, but it better be damn good...like pointing out how Heinecke lies.
