Rule 35 (ed banc) states:

"A petition for a rehearing en banc must be filed within the time prescribed by Rule 40 for filing a petition for rehearing."


Rule 40 (Petition for Panel Rehearing) states:

"Unless the time is shortened or extended by order or local rule, a petition for panel rehearing may be filed within 14 days after entry of judgment."

but I can be wrong.

Are you saying within 14 days of en banc petition, the court will decide To take it or not?

Great, the only blessing since 3/31is the quick appeal rule, it is absolutely brutal but fast at least.
