I think you have hit it on the head.

Dyk sounds too eager/anxious and the other two judges
don't need to hear anything more.

As far as the other attorneys....the judges did not need to hear anything from them because they had already made up their minds.

When everything about Amarin has a history of disappointed it is hard to predict something positive, but......maybe this time!

I agree, there is always speculation with Amarin, hopefully it will be 2/1 a win for us...

jerrywhoo - Your thought process is logical. I hope you are correct in the end. There were the briefs, and the amicus curiae, which both could have made a definitive case in either Judge Hughes or Judge Reyna's minds.

And given the mountains of evidence 'proving Nevada ruling wrong' - how can appeal court do other than 'correct this'.

Renome of US Legal Systems is stake here, very much also outside USA.

What is easy forgotten is that - it is the small 'David' - against two giant 'Goliath' companies - that has built their entire business around 'stealing' products from developing companies like Amarin.

Amarin: 550 people + now 800 sales force.

Hikma: + 8.500 employees
Reddy: + 22.000 employees

Hopefully US CAFC judges will in the end make the right decision - as you point out, could well be the case.

I am with you too. The attorneys on this board explained the process of appeal before - judges do convene before OA to exchange notes, and play the tactics that you described at the argument. So what you said is quite reasonable, and could be what had happened at the OA.

The only thing I wished is Singer handed some questions a little better. But he did a fine job today.
