Nope. O'Malley and Newman were on Singer's big case. Panel E would have been close to a slam dunk.
But we should not get too discouraged by this Panel, especially considering that the oral argument has not yet even started. All 'woe is me', 'doom and gloom' should at least be reserved until after completion of the oral argument. Let's see if this Panel gets it or not.
