The way I read it, it sounds like that $21 is factoring an appeal victory but no comment on Evaporate. Do you read it differently?

$21 PT is not based on "as is conditions" - it assumes AMRN wins the appeal, and it's not clear whether the PT includes any valuation for EU - I assume not since it wasn't mentioned.
