Yes, that’s Amarin's excuse right now...”administrative”.... but are you familiar with the CAFC going into oral arguments blinded by two parties that can’t figure this issue out without courts help? No way is CAFC going into Oral arguments without full briefs of consolidated cases, what happens when the two parties give conflicting statements regarding consolidation? At minimum the two parties will have to file a joint brief beyond the consent judgement signed by Du. The consent judgement and Amarin’s filings with CAFC ALREADY conflict Amarin’s recourse if they lose CAFC ruling.
Time will cure our disagreement, if the CAFC doesn’t approve the joint motion to skip briefings by the end of next week and/or Amarin and Hikma don’t file briefs Oral arguments IMO are not happening.
