I do not know whether that right of first refusal applies to treating Covid-19. But if we do not partner, then the right of first refusal would not apply anyway.

You are correct, IPIX gave no rights whatsoever to AS in regards to CV, only UP/UPS indications.

The License headings tell the story:
Right of First Refusal for Oral Drug Product(s) in Ulcerative Colitis/ Crohn’s Disease (UC/CD) Indications.

Right of First Negotiation for drug product(s) in Other GI Indications.


There's no concern about an AS use of B for Covid. They have no applicable rights in the Agreement.
