I do not know whether that right of first refusal applies to treating Covid-19. But if we do not partner, then the right of first refusal would not apply anyway.

I know you did not ask me, but my understanding was that these related to IBD uses for B, and B for covid was in no way involved. There was no covid when AS licensed a single B use, for UC as I recall.
