Based on the Judges questioning and both sides rebuttals which way are the Judges leaning in the case? We've been hearing from our legal experts on this board that we will have a good idea based on the type of grilling questions the Judges may ask one side during oral arguments which way they are leaning in the case based on the briefs that were filed.
Yes this confirms that oral argument is not where cases are won or lost. This subject matter is so technical in nature that the decision will be based on the briefs and the record.
Thanks Raf for the link. There is plenty of time for Singer to hammer home all the illogical errors of the District Court’s decision on 3/30. In listening to Immunex v Sanofi OA all I envision is Singer just torching H&R. That is if the briefs don’t put a stop to this prior to 9/2.
IMO we are clearly and convincingly better than 50/50 odds of reversal based strictly on all briefs submitted. Holding my shares firm with both hands.
