Yes. But if this case is ruled on by just briefs the Appeal panel should also be noticed of Du's bias... There's no chance Panel finds out about prior Du ethics case and her not recusing herself from second case.
Because the first case is unresolved the Panel should not be notified of this complaint, but for the life of me I can think of no reasons why the panel should not be noticed of the unresolved complaint and Du's lack of ethics to recuse herself from the random assignment of case #2.
Perhaps I'm overthinking this but it seems unethical to not recuse your self from a case with an ongoing complaint...it's professionally insane IMO.
