Since one of judge Du's major errors was that the PTO did not consider Mori and Kura, which they did by multiple levels of supervisors...it would be helpful for Singer to address this issue with the panel if oral arguments are convened....that the concept of the PTO's failure to consider these studies before they approved the patent is another factual mistake.
