Eight, I think your #3 is a misnomer. Is there case law stating how SCs are to be treated? If no, then the question is moot. If yes, then the question has no significance since Singer would be tasked with making it clear the decision should be overturned on the grounds the court made a decision contrary to well established case law
How strong the answers need to be to convince them to overturn Du's verdict. Even if they find that Du made an error, what does it normally take to overturn a decision by a another judge. Are our expected answers to such questions strong enough to get the overturn?

a) How many cases reach Oral arguments? b) how many cases similar to ours have been over-turned?
