alm, thank you for your feedback, and sharing your concerns. I actually did ask that the Ninth Judicial Circuit act with haste.

But no matter, the good news is that you need not have any concern about the Judicial Misconduct Complaint having any effect on the Appeal whatsoever. There is literally zero chance that what I am doing will have any affect on the timing or disposition of the Appeal.

The issue of bias, or perceived bias is not before the Federal Circuit. The filing of the Appeal transferred jurisdiction over the substance from Judge Du to the Federal Circuit. They are a higher court which operates on their own timetable.

They do not care about whether a public remark made by the lower court judge in an interview creates a perception of bias. That issue is not before them. They only care about the issues which have been briefed and are before them. So, no worries.
