The WF plaintiffs never got their class certification, so they can be bought off individually and cheaply, both because there are few of them and because they are in a very weak position having had their case dismissed.

There is a short time frame for the administration to try and dissuade an appeal. I think it is possible if FHFA and Treasury become more vocal about their plan, but even if they appeal I think the action FHFA and Treasury eventually take will moot them anyway.
