Inducement of Infringement is a viable cause of action. The question is whether factually, the insurance companies are actually inducing infringement.
We had an extensive discussion on this matter here about two months ago, and from what I recall, the conclusion form people who knew what they were talking about, such as cardiologymd and pharmacydude, was that they were not inducing infringement. I could be wrong. It is an interesting issue.
