I have a hard time believing that Thero, after suffering through JZ and the Anchor AdComm debacle, would have gained enough confidence back to take this risk. Of course we don’t know the truth, but I would be more willing to blame Covington for bad legal advice. I wouldn’t be surprised if Covington half assed it because they burned a few bridges winning the first amendment case only to see Amarin do nothing of substance with it. But that’s just my opinion.
