The composition of matter patents will hold no water here if the generics can claim chemical equivalence ratified by the FDA. The encapsulation perhaps but this is easy to get around...no one is claiming biological equivalence just chemical identity. As for non-obvious methods of use, the only one that holds water after the Du judgement is the use to lower ApoB. As I understand it, Amarin licensed the EPA purification process from Mochida, then perfected their own oxidation prevention encapsulation technology.
