I agree. Covington should have impeached Heineke's testimony on cross examination for the record and either not used Toth or clarified Toth's testimony on redirect. The ambiguity from the expert witnesses gave Du the tools to justify this ridiculous decision.

With that said, I'm glad we've got Singer and believe that we've got a fighting chance to overturn Du's decision.

The legal team could have done better. But it's naive to think she couldn't simply ignore a few more pieces of evidence.

Will Lar, I agree and place the vast majority of the blame on Covington, Amarin’s in house legal team, and obviously Judge Du for her leaps of faith conclusions and errors. IMO
