You are correct from a strictly medical and biochemical viewpoint.
I think however that Silbersher's thesis is that the time for arguing the merits of the prima facie evidence on its merits is fading, and that Amrn's best recourse now is to find Du's procedural errors and point out clear errors in enacting the law or adducing the truth from the evidence that was presented. That last word presented is also germane, as we cannot ex post facto correct the Du mistakes of adjudication of the facts, unless the means to do it was already in the trial briefs or crossexaminations and always assuming the CAFC panel of judges allows it.

PS On the matter of the Friedewald equation, it becomes key in discounting Hayashi as even if we had one patient with TG>500mg/dl, the equation breaks down in accuracy (as you we all know) at ~400 mg/dl. There fore we have less idea about that one patient's actual LDL than when the Coronavirus will strike again and where.....
