Kim is getting his direction from Maxim at this point in time, while still in the uplisting's quiet period.

Maxim didn't have an issue with it...

So Kim authorised it.

Realise a quiet period can go on until NASDAQ feels said company has met the necessary requirements.

In other words, there may be several communications to and fro.
