zip, if the AC lets this pass and there is new case law, I cannot see how the SC doesn't take up this case. The SC on average takes about 6-8 cases a year out of the Federal Circuit. This would be one of them...especially when it flies in the face of SC president and there is so much disagreement on the evaluation of obviousness. An AC affirmation would turn that disagreement into confusion throughout the court system. I just don't see that happening.
