I fear JT and BoD are not for turning.

I think, for Amarin, settlement option was not ripe until now. I believe JT and BoD will sit down and discuss the following options and potential outcomes:
1) Amarin takes decision to Judge panel
A) Amarin wins...conducts business until generics take case to Supreme Court (Written description)
B) Amarin loses...case is tied up and potentially goes to Supreme Court...

2) Amarin settles and conducts business

3) Amarin sells company and problems, unlikely 1) above leads to successful M&A with Supreme Court overhang 2) Is the only clear pathway to M&A

Settlement is ripe and the only pathway moving this forward to conduct business.

Amrn has showed a willingness to negotiate and settle with Teva and Apotex. Based upon these settlements we have an idea of the terms Amrn is willing to accept and what they are willing to concede. When you and other posters on this board keep stating to settle you are oversimplifying a resolution that probably was not viable with H and DrR. Either they asked for too much, or they simply were unwilling to settle. Amrn may have had just as much to lose by settling for unreasonable terms as they did by losing the court case. The generics had virtually nothing to lose if they did not like Amrns offer, if there was one, and everything to gain by letting the case be adjudicated. In hindsight the generics were smart to let the court decide. For a variety of possibilities Amrn may not have had the option to settle this and still may not.
