raf, I have to ask why you would want him to focus on statistics? The Bhatt paper is out there and I am sure it has come to the attention of the court, even if only a clerk. Singer putting statistics of Mori takes away from what he is trying to accomplish. He wants the court to take a holistic approach to the case and not get distracted by one thing. Any one thing can be argued it wasn't biased, but as you broaden the scope of the evaluation, it becomes painfully obvious the mistake was right from the beginning. This big picture look is what Singer wants the court to see. We really don't need Mori statistics. We need the court to think about the many questions that Singer raises and ask why they all went in one direction. Even objective indicies like unmet need were diminished in value by Du. As he pointed out, no matter who the judges are, if they look at it objectively as he has tried to demonstrate, we will win.
