True, but as we have seen, we have the infringement cases being ruled upon by Judges that apparently are in over their heads. An interesting idea to remedy this, would be to appoint 1-2 judges in each District (or 1 Judge to cover several Districts depending upon what is warranted by volume), and that judge will have an intellectual property law background, will not be burdened with hearing criminal and other cases, and will become a specialized trial court for the disposition of these cases on the trial court level.

By way of example, in the New Jersey state courts, there is a specialized Chancery General Equity judge in each county who hears a narrow scope of cases involving equity matters, and within the last few years, each county has assigned a complex business judge to specialized in adjudicating the complex business cases separate and apart from the personal injury and standard contract cases which comprise most of the civil docket.
