Michael- This is a great mindset to have to keep your sanity, but it’s based on your emotions. Defendants will need to mitigate there potential losses which could occur if they win and don’t settle. Defendants legal actions don’t go away if they’re victorious in appeal. Defendants are not confidant in winning appeal, their arguments are shotgun based while Singer is focused. Singer will outperform and you’ll see how ridiculous this shotgun approach was...look for Singer to use “shotgun approach”;)
Best business decision H&R could make would to settle for terms better than Apotex & TEVA....this can occur in joint appendix and court can rule on breifings only.
