Yeah, but it really means nothing until we get the verdict on the appeal. We have to win the appeal first for this to have any meaning... and if we won the appeal, it would greatly enhance our ability to have won the case with Apotex. They probably understood that and thus settling gives them a 6 months head start against the other generics other than Teva. Not settling and risking losing to us would have cost them a lot of money and a chance to get a head start on the rest. They lose nothing if we lose the appeal and gain 6 months if we win. So they were hedging their bet that an appeal win for us enhances the likelihood of us winning the lawsuit vs them. That is what I think led them to agreeing to settle.
