This was the most cited case in Amarin's Brief. So much so, that in the Table of Authorities, rather than listing the pages where it is cited, the Table of Authorities says, "passim", which is used in Briefs when a case is cited so often, it is redundant to list the page numbers.

The more I think about it after the education received form Hamoa, that the outcome of this appeal will hinge largely on the application of this case to our facts. Like I said, it will be interesting to see how the generics attempt to distinguish it, and then how Singer on reply, re-emphasizes its potentially controlling application.
