B - that is the only reason that I can think of but it is inexcusable.
They were hired to win. It was on them to foresee the unforeseeable. If their lives were dependent on winning this case, would they have done a more thorough job?
You are the attorney, not I. Tell me if hiring a biostatistician to turn over every piece of data in that limited amount of studies be an unreasonable task, just in case they encounter a wacko judge?
