Why do you think *this* piece of factual evidence is the one magic key to change Judge Du's mind? She ignored other independently disqualifying aspects of Mori, and related expert testimony, and she ignored applicable legal precedent.
Please don't misunderstand me: I'm not trying to excuse Covington, it's their job to have everything together. If we're being fair, there were arguably better arguments that actually did make their way into the trial record.
