Montana...my recollection is that the USPTO definitely considered Mori and Kura as well as other studies but they did not cite all of them in their approval of the patent...This prompted judge Du to erroneously think that the PTO had not considered them...I would have to read her decision again in order to answer your question of how plainly she stated this error in her decision, but it was her misunderstanding.
