Eight...This case started with the Generics' claiming prima facie obviousness of the Marine patent...and I believe the Generics' rebuttal of the Singer brief will end with the same claim.... The Generics will opt to avoid discussing the errors in Mori and in Kura nor the errors in dealing with the secondary considerations...but will spend time concentrating on the original rejection by the USPTO..and hope that they can convince the CAFC judges as they convinced judge Du.
