Bouf...Judge Du showed her bias and lack of impartiality when she made new law by balancing positive secondary indicia against negative indicia....Her method of dealing with the secondary indicia was an extreme example of her method of cherry picking facts negative to Amarin throughout the case.

Bouf, Postes - Bouf, your experience gives me added confidence in my thought process. I was just thinking the very same thing before I read your post. The appeal process is "CUSTOM MADE" to magnify erroneous conclusions. Singer deftly lends praise to the higher court impartiality, while contrasting how the lower courts can fall victim to infection.

If Judge Du's decisions turn on her indignation at "arrogance", she utterly lacks the temperament to adjudicate federal cases with lives, businesses, and public policy at stake.

If she managed herself to a single "fishy oil salesman" remark for "arrogant" lawyers to stew in, but otherwise ruled according to law and facts in the public interest--such a response would have been proportionate. Judge Du failed to do that.
