I'm not disagreeing with you that the burden is on Amarin to demonstrate clear factual error. You need to read the brief more carefully. The issues Singer raises aren't questioning where Du is deciding on the credibility of Toth vs Heinecke. She is literally misinterpreting what she is being told.

The conclusions she is drawing don't even come from Heinecke's testimony. She's drawing her own bizarre conclusions from the testimony.
