alms...When Judge Du took this trial, she noticed the PTO had rejected Amarin's patents before approving them...This observation came prior to her considerations of Mori, of Kura, and of the secondary idicia...and she decided to use this initial rejection as prima facie evidence of obviousness.

The PTO rejection formulated judge Du's hindsite(there's not a better term for it)...and she then interpreted all the other evidence to back up her decision and put the burden on Amarin to disprove the evidence.
