It is going to come down to the judges. I agree with you here. Does JT realize this? Is he going to roll the dice again?

What is his ultimate play here....

Greymatter1

And I find it disturbing that in spite of the information we were given about product stability, manufacturing difficulties raw material availability, and supply chain, the generic version is approved only a few weeks after the DC decision???

Generics most likely are using previously approved suppliers of Vascepa (eg BSAF). The Supplier(s) own their own manufacturing patents/IP, not Amarin.

Plus, most importantly, Amarin did not spend the Big Bucks to have exclusivity contracts with all suppliers for a guaranteed, "take it or pay for it" basis

Greymatter1:

Thank you for your note. What an intriguing matter we are all dealing with here. Thus is one for the history books.
Trust me, I am not without emotion and frustration. Something to be said about the best laid plans...

Having said that, you are quite correct. There are dark forces working against this company and drug. Some are darker than others. Remember, this drug Vascepa must survive. It has a major role in saving lives. As a generic in this US it will not fulfill that promise. So, this appeal must be won! My faith is challenged daily. All of us are. Yet, I still have faith. Amarin will make it through and Vascepa will help millions.

I think the good guys need to keep fighting and we need a win.

Greymatter,
I believe the dark forces against Amarin could be a simple, non written agreement among BP to DELAY, by whatever means, the bringing of Vascepa to market. I suspect that BP's research labs are desperately trying to come up with the exact mechanism which makes EPA work(which is not known by Amarin). Once BP can explain the mechanism, they will have a new patent that leaves Amarin behind. Just a theory. Dave

Graymatter@ What your really saying 'is that USA legal system - 3. branch of government is generally 'corrupt' (you have seen it so many times - you say).

You are saying that not only 9. district judge Du - didn't know 'what she was doing (possibly corrupt in her +7 billion$ ruling) - but the Whole og US law system is rotten.

Being from abroad - I have to believe in that - 'in the last FREE Nation in the world - the regulatory sytem is stil Honest and Fair - 'in the end'.

And I have to trust that 'the Appeal that Amarin has filed - must Win for 'Justice be Restored'.

Jasbg

NB. In the end the faith of Amarin in Appeal court 'for me' - will be what makes USA different from Communist China.

If Patens are not Restored - this might as well be happening in China or Russia.
