Their Brief will be a combination of their post-trial Briefs and Judge Du's Opinion. They will basically say, "Judge Du's thoughtful Opinion got it right!" Beyond that, it will certainly be very interesting to see what new material they come up with in their attempt to rebut Singer (by new material I do not mean new evidence, but new spins on their position).
Does it matter? Du erred in countless ways but it still seems to depend on the judges (from posts by others). Du could rule the sky is red and, given the right panel, be upheld.
