if we don’t get at least 2 of the 3 (Newman, Reyna, O’Malley) odds of winning are basically nill.

I do not think: "prima facie" vs "totality" argument is one of the weakest - or the weakest - argument.
I will not be surprised if it will not mentioned in the brief.
