While I agree with HD that the appeal should and will be about factual, legal and procedural errors, I also agree that there is a 'human' aspect to it, that Amarin should exploit (couldn't think of a better word).
By 'human', I don't mean touchy, feely, sensitive stuff. I mean painting a broader picture than what can legally be painted within the 4 corners of Amarin's brief / arguement.
IMO Thero gave a glimpse of that when he gave his (pre-recorded) speech: history, impact on USA CVD patients, price.
Judges are human beings, just like the jurors whose opinions may be impacted by the news coverage that they are told to avoid watching.
Will there be amicus briefs, painting a fuller picture?
