JL - I hope all you mentioned, and more, file Amicus briefs. Will we know if such briefs are filed? Would they be on Pacer?

Who in their right mind is going to put up the money, millions and millions of dollars and all that time and risk...If some DC judge; who, can not even get her facts correct; can counterfeit the PTO opinion as to patent validity and make an end run around the the Hatch-Waxman legislation

This case is not the first one when a patent was invalidated by a DC Judge. A ton were invalidated and the DC decisions were affirmed by the CAFC

Is a situation in which the sum of the total does not reflect the magnitude of the harm that this decision will do..And that is what the AC judges will consider if they are indeed wise..What will be the consequences if Du's opinion is upheld..And of course it is the job of Amarin's legal team to point this out.

I hope Amarin will not waste a singe word (in the briefs and during oral argument) about it, since it is not a valid argument in this (legal) case. The appeal is about factual and legal / procedural errors.

JL, you couldn't have expressed the outrageousness of our circumstances better. HDG has given us a master class in understanding the legal codes applicable in this case, their proper application, and Du's mis-applications. I'm still hopeful, that our outrage does reverberate within the court's setting. To that end, HDG shows us, that there's clarity to be found in the language of the law. The system gives us three new Judges and a star attorney. With his guidance, the court will have the clarity to rule in our favor. Our outrage shall be rememdied, when the system works as it's intended.

Those consequences being a chilling effect on future medical research. ...AND don't think the FDA, the USPTO, BP, the AHA, the ADA and the AMA are not going to be weighing in with Amicus Curiae(S).

Jesse, i'm with you 100% having said that my conspiracy mind says this may be a one off ie look the other way on this one but if BP owned the molecule then don't look the other way... I have a bunch of dough saying it gets reversed for exactly what you are opining plus i'm on the molecule and my labs are superb by comparison... EVERY type 2 in the world would benefit from 4 g's daily
