Marz, I was thinking the same thing when I read that. Amarin would have all the pieces of that argument up until it came to the commercial success. Not sure if net profit is what the judges would pay particular attention to and if they would listen to the idea that until final FDA approval Amarin could not really roll out the big Ad campaign but that definitely made me wonder if it might be a losing argument since up till now you can't say it has been a commercial success for Amarin. They might argue this damn trial has impeded that, but even then if you look at Amarin's forecast back in January or before they were not forecasting break even for 2020.
