@Jas there is no way to predict what the sp would have been had there been no suit. Therefore, there is no way to quantify losses for suit purposes, based on sp, particularly if amrn wins the appeal and the sp recovers. I have would think a lawsuit for losses would have to be based on potential revenues losses.
If for example, DC approval is received say Jun/Jul and amrn holds back tv ads until the case is resolved say Q4, (to avoid promo that would benefit generics), there may be a claim for potential revenue losses during that period, had there been tv ads.
Not a lawyer either and just my opinion.
