Yes a good write up of the error made by Du. But not to throw cold water on this, all here need to understand just how an appeal is looked at by the judges.

Let me use a somewhat simplistic example, so excuse that. But trying to show just how this works. So here goes...

Lets say that in the trial record there are 5 findings of fact by the judge...#1, #2, #3, #4, #5. The verdict is appealed by the party who lost. They show that the judge was CLEARLY ERRONEOUS in the finding of fact #3.

This does NOT make the case immediately reversible. The judges on the appeals panel will look at the TOTAL trial record, all of the findings of fact, and ask themselves this question: Can the trail judge still have come to the same conclusion even though the Finding of Fact #3 was incorrect?

This is just ONE of the reasons why to win an appeal is difficult....
