Although doctors are allowed to prescribe off label the advertising is restricted to the marine label. It's more than a matter of trademarks.

They need Amarin to do that for them which is exactly what they would be doing if they proceed with their marketing campaign in hopes of an appeal win. Folks would go to the doctor asking about Vascepa but will get prescribed generic Vascepa.
