you cannot possibly resurrect the patent by cutting a deal with hikma; the patent is gone barring a reversal of the verdict by the appeals court

If you're an attorney, you should already know this. A judges decision does not get tossed if both parties come to an agreement after the fact. It has nothing to do with pessimism.
