hayward, you are correct, we did lose...so what, we are not appealing that same case. My point was she controls who hears the case. The Harvard professor has her as a stickler for procedure. There will be political pressure from the outside like the ITC case. I felt the Court ruled the way they did in the ITC because of procedure...that being there was an established process with the FDA taking the lead and they were not going to change that. This one is probably more precedent about procedure than that one as this has previous rulings showing Du erred in her decision.
