I kind of get your idea and like it.

But doubt Teva would step up and get nothing in return for 2nd scenario. I would say, share the market with Teva, kind of like partner, we can possibly scavenge half (roughly, depend on detailed partner terms, Teva got another half) of original US market back.

Vs:

1) appeal and win, lost min 2 out of 9 years of patent time; risky and low odds no matter how ridiculous the current ruling is; or
2) appeal and lost again, nothing.

I feel the above could be the best strategy for US mkt if it is legally feasible.
