The substance of the appeal will have to rest on that -- the flimsiness of the evidence that Judge Du made the centerpiece of her decision.

Three tiny Japanese trials that had to be combined to create "obviousness" -- with all other trials and opinions ignored. That's what the appeal has to rest on.

marjac, I don't know how Du succeed in applying the “clear-and-convincing-evidence” standard by using the Mori case. Do you?

I honestly have never heard of Mori before this was brought up at trial...If you can find information on this trial please post it..I know it was not brought up at the PTO..
