Is there a compelling reason for this to ever change? Is there a legal requirement for this to change? If so, is there a timeframe for this to happen?

Why would the FDIC have anything left for equity?

They must follow some variation of waterfall and all available money must first got to DEBT and they will be lucky to see a dime on the dollar
