The filings on 2/11 and 2/12 deal with redactions and a statement stating why certain exhibits/redactions should be sealed. These documents are either submitted to the Judge independently of the ECF system, or filed under Seal. The subject matter is self-explanatory in terms of why we have not seen anything on the docket, as a public filing concerning the sealing/redaction of documents, would defeat the very purpose of the filing.
We have two big filing days coming up: (1) 2/14 when amended proposed findings of fact and conclusions of law with citations to the Transcripts are due; and (2) 2/28 when post-trial Briefs of no more than 30 pages are due. If nobody beats me to it, I will copy and paste those filings for the Board to review.
These filings are very exciting, as they will perhaps, diminish some of the anxiety concerning the trial outcome. We will be able to review these filings, and draw conclusions from these filings as a Judge or Jury would do.
Hopefully after review, we will see very clearly from the strength of Amarin's filings and the weaknesses of the generics' filings, that a victorious trial outcome is not just a strong probability, but a virtual certainty.
