Kev, you are incorrect in your statements.

1) Filing of a “notice” of appeal from a final federal district judgment is made in the district court where the judgment was entered as well as in the Court of Appeals having subject matter jurisdiction over that district court’s judgment. If jurisdiction to hear such an appeal exists, the Court of Appeals(here the Fed. Cir.) has no voice in “accepting” the appeal or not “accepting” the appeal. The appeal exists and will be heard in appropriate further proceedings.

2) The % of appeals turned away by the Fed. Cir. that you opine on is ludicrous in the number or % cited.
